We have been providing our clients with comprehensive legal advice on Czech, Slovak and EU competition law for many years. Our services include the assessment of notification requirements under competition law regulations, foreign direct investment (FDI) screening regimes, as well as the EU Foreign Subsidies Regulation (FSR). We also advise on cartel agreements, abuse of dominance, state aid and public procurement matters.

We assist clients in administrative proceedings relating to the above competition law issues before the Czech and Slovak competition authorities and the European Commission. We also advise on competition law aspects of international M&A transactions across a wide range of industries, particularly financial services (banking, insurance and related sectors), telecommunications, media, energy, engineering and transport. In addition, we provide legal support during unannounced inspections conducted by national competition authorities or the European Commission (so-called dawn raids).

Merger Control (Mergers and Acquisitions)

We provide comprehensive competition law support in mergers and acquisitions. We assess filing requirements, structure transactions to minimise regulatory risks, prepare submissions for competition authorities and represent clients in merger control proceedings in the Czech Republic, Slovakia and before the European Commission. Where necessary, we negotiate commitments and remedies that enable transactions to proceed without adversely affecting competition.

Administrative Proceedings and Competition Litigation

We represent clients in negotiations and administrative proceedings before competition authorities, including investigations concerning abuse of dominance and prohibited agreements. We also have extensive experience representing clients in judicial reviews of competition authority decisions, including proceedings before the courts of the European Union in Luxembourg.

Competition Compliance and Prevention

Together with our clients, we place a strong emphasis on preventing even inadvertent breaches of competition law. We design and implement competition compliance programmes, conduct competition audits of existing and planned business projects and strategies, and provide practical training for management and employees. Our objective is to reduce regulatory risks and strengthen our clients’ legal certainty over the long term.

Anti-Competitive Agreements (Cartels)

We advise on prohibited agreements between competitors, including cartel arrangements and vertical restraints. We help clients identify risky contractual and commercial practices, establish internal processes compliant with competition law requirements, and represent them in proceedings where significant sanctions may be imposed, including substantial fines or exclusion from public procurement procedures.

Abuse of Dominant Position

We advise clients holding significant market positions on designing commercial and pricing strategies that comply with competition law. Our work covers pricing policies, exclusivity arrangements, access to infrastructure and predatory conduct. We represent clients in administrative and judicial proceedings relating to alleged or actual dominance in the market.
